PAY FIXATION OF EXSERVICEMEN RE EMPLYED IN SBI ON OR AFTER 01/01/2006

Sub. FIXATION OF PAY OF EX-SERVICEMAN RE-EMPLOYED IN THE BANK

Sir,

   1.      I Vaibhav Biswas an employee of your high esteemed organization joined this mammoth bank on 15 Dec 2010 as ex servicemen, have the honour to state and request to your good office that please refer the attached file (honourable court’s judgment in connection to the fixation of pay to the ex-servicemen ) and  IBA old circular no. HR&IR/MV/76/589/1822 dtd. 15th November 2011 latest circular no. HR&IR/MV/76 /589/1973 dated. 8th December 2010(copy attached) and the guideline issued by Ministry of Finance Department of Financial Services (copy attached) by O.M. No. 3/19/2009. Esst. Pay dated 8th November 2010 from DOP&T. vide their letter no. 4/1/2010-SCT (B) dated 22nd November 2010, advising the fresh guidelines in relation to  the above captioned matter, it is to intimate you as I was not protected with the last pay drawn at the time of retirement from my previous service by ignoring all the elements of basic pay (PAY IN BAND+ GRADE PAY+ MSP+X-PAY+GCB ) and the DA which was not reckoned for the fitment and may please be taken into reconsideration for the re fitment according to the guidelines of the O.M. issued by the Ministry of  Finance Department of    Financial Services re-circulated by I.B.A.

2.      I further state you that the last basic at which I retired from Indian Air Force was Rs.17640 (the sum of Pay in Band, Grade Pay, X-Pay and MSP) and the then DA @ 27 % was Rs.4763 (last pay certificate attached) but the basic pay that has been paid to me in the bank is Rs.10500, which is way below to what my counterparts in other circles (copy attached) and all other PSU banks all over India is drawing. This has caused a huge disparity and imbroglio in the pay fixation which is definitely frustrating and demotivating as far as the highly motivated, dedicated, disciplined, and highly skilled manpower is concerned and I think this long pending issue needs your interventions and kind considerations.

3.      So Sir I request to you kindly fathom and reconsider my fitment according to the guidelines issued in the O.M. and the circular issued by IBA.
This is for your information and necessary action. I attach all the relevant documents for your ready reference and perusal.

  4. What is present position of the pay fixation ? There are so many esms are with the similar type of cases.

    please post latest position so that other esms can be benefited.

  5. sir what about those ex-warriors who retired before 2006 and joined bank as a clerk after 2006,
    how their pay will be fixed? what is IBA guidelines on this?
    what are the circulars ?

    my pay fixation was done without inclusion of msp
    pls clarify
    whether msp to be included during pay fixation or not
    if yes

  7. Dear Ex-friends,
    It is learned that there is NO Circular of GOI/MoF/MoP/PSB/IBA precisely states what should be protection of pay of re-employed EXSM in PSBs, after the 6th Pay Commission implementation and also after 9th BPS-2009. The convention is being followed as per the 1983 order, which was issued at the time when there was no Pay like GP/MSP etc than Basic Pay.
    Those who approach High Court/Apex Court against disparity in Pay Fixation can only (R) can only get the protection for him, if he/they presents the case unflinchingly ..... Hope all follow......... and your doubts are cleared.

    corporate centre Mumbai State Bank of India has released one more circular CDO/P&HRD-IR/74/2013-14 dated 18 feb 2014 regarding pay fixation of ex servicemen re employed in public sector banks
